The California Supreme Court of Justice rebuked by a new obscenity law that regulates abortion in the U.S.
A Texas judge ruled Friday that the Food and Drug Administration acted oddly when it approved the abortion pill more than 20 years ago, just as a Washington state judge issued a conflicting ruling.
In a statement, President Joe Biden called the decision “another unprecedented step in taking away basic freedoms from women and putting their health at risk,” saying his administration would continue to fight it in court. He called on voters to give Lawmakers explicit protection for abortion access, saying it was the only way to stop future decisions like that.
Some of the states that disagree about the Kacsmaryk ruling deny that it outlaws medication abortion, a procedure that accounts for over half of US abortions. The office of California Governor has reiterated that abortion is still legal in California, and that they are not going to stand by as fundamental freedoms are stripped away. Likewise, New York Attorney General Letitia James issued a statement that “abortion continues to be legal in New York and New York will remain a safe haven for anyone seeking abortion care.”
The case is noteworthy due to the fact that it used an obscenity law that banned the shipping of materials related to abortion. The opinion approvingly interprets its ban on all article, substance, drug, medicine, or thing that is advertised or describes in a way that leads another to use it or apply it for producing abortions as a ban on mailing Mife Pristone. “The statute plainly does not require intent on the part of the seller that the drugs be used ‘unlawfully,’” Kacsmaryk writes. It’s another sign that long-dormant obscenity rules are being resurrected following a failed attempt to ban books in Virginia.
But in the short term, the ruling’s potential effects are muddy and reliant on the Fifth Circuit Court of Appeals, which could reverse the stay. The ban on internet moderation was allowed by the Fifth Circuit. In February, members of the nonprofit Women’s Law Project argued that the FDA had substantial power to limit the ruling’s effects even if it were allowed to stand. Its response may determine whether manufacturers and sellers of the drug maintain patients’ access to the pill in the face of legal uncertainty.

While low-grade fevers and chills are an expected side effect of misoprostol and aren’t life threatening, if a fever persists for more than 24 hours after taking misoprostol, it could be a sign of infection.
The FDA approved the two-drug regimen to end pregnancies up to 10 weeks, but the World Health Organization says it should be done up to 12 weeks. After that, they’re less likely to be effective and may cause more bleeding and cramping.
Several states say they are stocking up on medications used to induce abortions as a major abortion pill appears poised to potentially become unavailable in the U.S.
Aid Access, for example, is based in the Netherlands and will mail mifepristone and misoprostol to patients in states where abortion is banned. Pills sent from abroad are not subject to FDA approval and safety regulations. U.S.- based health care providers are employed by the organization, who prescribe FDA-regulated abortion pills via remote visits to states where it’s allowed.
The governor’s office has made plans to get an emergency supply of up to 2 million pills of the anti-seizure pill misoprostol, which is subject to legal battles in federal courts. Officials say the state currently has more than 250,000 of the pills already on hand, which were purchased for about $100,000.
Gov. of Massachusetts said that the state has more than 15,000 pills of the contraceptive in their possession. Last week, Washington Gov. Jay Inslee announced his state had prepared a stockpile of about three years’ worth of mifepristone.
Newsom’s office says the pills were secured through the state’s CalRx prescription drug program, and California is providing information about its purchase agreement to other states that may be interested in taking similar action.

Clinics that Provide reproductive health care across the United States are bracing for restrictions after the US Supreme Court ended legal protection for abortions nationwide.
At the Northeast Ohio Women’s Center staffers are talking to patients who want to change their minds about getting an abortion next week.
Doctors rely on the drug to open the uterus when a pregnant woman is having a miscarriage and to help them end a pregnancies if they’re at risk of fatal defects.
When a pregnant woman becomes too risky, time is of essence, according to Dr. Alison Segal, who directs complex family planning at Oregon Health and Sciences University.
She said that the quicker we can have someone not pregnant, the better and that it would make it safer for patients.
Doctors still have other ways to treat the problem, but when looking at the needs of individual patients, they will not be able to use a valuable tool.
“We have our gold standard of what we provide – the safest, most effective regimen – and then if it’s not available, we use the next best one. And that’s what we would be left with,” Edelman said.
“They want to see a national ban, and this is in fact what they are going for in this case,” said Kristen Moore, director of the EMAA Project, a nonprofit that is seeking to make it easier to get abortion medications in the US.

What will happen next is far from settled. Appeals were filed to stop the ruling in Texas from taking hold, and higher courts will have to weigh in.
Carafem, which provides telehealth abortion care, has been using a misoprostol-only regimen since the Covid-19 pandemic began, Chief Operating Officer Melissa Grant says.
“The clinicians would have to use these other options instead of choosing based on their own expertise, knowledge and judgment when rendering such care,” Dr. Iffath Hoskins, president of the American Congress of Obstetricians and Gynecologists, said Monday. “Frankly, as a clinician, I do not want to be in that position.”
Misoprostol is approved by the FDA to prevent and treat gastric ulcers caused by nonsteroidal anti-inflammatory drugs (NSAIDs). It is used for a wide range of reasons including to treat other types of ulcers and to decrease blood loss after delivery.
It is a little old-school, but we could do it, said Dr. Kristyn Brandi, an ob/gyn and abortion provider in New Jersey.
“Many places around the country that don’t have access to mifepristone, often due to politics, have been using misoprostol-only regimens for a long time,” she said.
A person who uses this method is instructed to use it sublingually, putting four pills under their tongue and leaving them there for 30 minutes, then swallowing what’s left with water. They can be used in the bathroom as well.

Typically, bleeding will begin within one to four hours after the first dose. Heavy bleeding usually lasts about three to five hours, but bleeding can last two weeks or longer, studies show.
“The more we give, the more side effects people will have. That isn’t the goal. It is our intent to make sure that the people have an effective response to the medicine as well as making them feel comfortable. I tell my patients that they do not need to go through with an abortion. That is something that is not the reason for this process.
“We do use off label medications when clinically appropriate; however, that should not happen here because we have over two decades worth of clinically sound evidence based information that this is valid option,” Hoskins said.
